A Bench of Justices Sujoy Paul and Dwarka Dhish Bansal was hearing an application by the State to appeal against the order of the trial court acquitting the respondent of rape causing death and unnatural offences under the Indian Penal Code, aggravated penetrative sexual assault under the POCSO Act as well as offences under the SC/ST (Prevention of Atrocities) Act.
While the bench allowed the application and directed the Registry to convert it into an appeal, a serious flaw was noted in the judgment under challenge.
“Sadly, in the entire judgment there is no whisper about that DNA report which was even marked as Exhibit P-29,” the court remarked.
