Supreme Court seeks UP Govt response on policy for premature release of prisoners aged 80 plus

A three-judge Bench of Chief Justice of India NV Ramana, Justices Surya Kant and Hima Kohli was hearing an appeal filed by one Kedar Yadav (appellant) against an order of the Allahabad High Court which had upheld the order of the Sessions Court and convicted and sentenced the appellant.

Advocate-on-Record PV Yogeswaran appearing for the appellant, informed the Bench that the appellant is 80 years old.

The Bench noted that the incident was from the year 1985 and the final order was passed by the Allahabad High Court only in the year 2019.

“Taking into consideration the peculiar facts and circumstances of the case, as mentioned above, let limited notice be issued to the State of U.P. to find out whether there is any policy framed by the said State to consider the case of premature release of accused who are 80 years old or above and convicted on long drawn trial,” the Court ordered.

Taking into account the urgency in the matter, the Court directed the registry to list the matter immediately after service is complete on the State government.

Advocates Ashish Kumar Upadhyay, Jaiyesh Bakshi, Vivek Tripathi, Y Lokesh, V Sibi Kargil, Anubhav Chaturvedi, Pankaj Agarwal, Bhupender Singh, Indira Bhakar and NBV Srinivasa Reddy appeared for the appellant.
