Justice Shampa Sarkar observed that the complaint did not disclose any cognisable offence on the face of it, and Section 295A of the Indian Penal Code, relating to hurting religious sentiments, would only be attracted if there was a deliberate intention.
“The registration of the FIR, in the prima facie view of the Court, amounts to curtailment of the right to freedom of speech under Article 19(1)(g) of the Constitution of India, and also the liberty of the petitioner,” the Court said.
